Hi, I’m Karen Eichman, and I’ve recently added the practice area of Legacy Planning to our law firm. I became interested in this practice area when my mother somewhat suddenly was unable to handle her finances. Although years before, Mom had a trust, will, power of attorney, and other important documents drawn up, those documents have not been the help I really needed to manage her affairs from 1,000 miles away. And, to top it off, when I called the lawyer’s office, where her documents were drafted just 12 years ago, the attorney had retired and copies of Mom’s documents were “in storage.” AND, there was no offer of help from the law firm!
I KNEW I had to find a better way for people to help their aging parents, and for parents to feel comfortable that their children would not be overwhelmingly burdened, in times of incapacity, as well as death.
And then there is the whole issue of my grandsons – one in Virginia and one in Georgia, with no family nearby. What happens to them if something happens to their parents??? Well, of course, if the parents have a will in place and their guardians are named in that will, that’s the answer, right? Well, what happens to my grandsons, from the time something happens to their parents until that will is actually FOUND, and the guardian’s (who could be as far away as New York or California!) can get to the grand kids? Where do the kids go? Who has the legal authority to care for them, in that moment? Just let that sink in for a moment…
